These terms apply to recruitment services supplied to business clients. Any specific terms agreed in writing for an assignment take precedence where they differ from these standard terms. Candidates are not charged a recruitment fee.
1. Acceptance and scope
These Terms of Business govern recruitment services provided by Dolmen Recruitment Partners Limited (“Dolmen”) to the organisation requesting or receiving those services (“the Client”). The Client accepts these terms by requesting candidate information, receiving an introduction and proceeding to interview, or engaging a candidate introduced by Dolmen. Any variation must be agreed in writing by a director of Dolmen.
2. Definitions
Candidate means an individual introduced by Dolmen to the Client. Introduction means providing information identifying a Candidate, verbally, electronically or in writing. Engagement means employing, appointing or otherwise using a Candidate’s services, directly or indirectly, in any capacity.
Remuneration means total first-year gross remuneration, including base salary, guaranteed bonus, sign-on payments, allowances and other guaranteed cash payments.
3. Recruitment fees
The fee is calculated on the Candidate’s first-year Remuneration:
25% for roles with a base salary of up to and including €70,000.
30% for roles with a base salary above €70,000.
VAT is payable in addition where applicable. Fees for contract appointments and any assignment-specific expenses must be agreed separately in writing.
4. Introductions and subsequent engagements
A fee is payable if the Client engages a Candidate within 12 months of Dolmen’s Introduction, whether for the original vacancy or another role. If the Client passes Candidate details to a third party and this results in an Engagement within that period, the Client remains liable for the introduction fee.
The Client must notify Dolmen promptly of an offer, its acceptance, the agreed remuneration and the commencement date.
5. Invoicing and payment
For a contingent permanent appointment, Dolmen invoices when the Candidate starts employment. Invoices are payable within 14 days of issue.
Retained search assignments are invoiced in stages as agreed in writing. Unless otherwise agreed, these are one third of the projected fee on commencement, one third on acceptance of the shortlist and the balance on completion, adjusted to the agreed remuneration package. Retained stage payments are non-refundable.
6. Twelve-week replacement search guarantee
If a permanent Candidate’s employment ends within 12 weeks of commencement, Dolmen will undertake one replacement search for the same role without an additional recruitment fee, provided the original invoice was paid in full within the agreed payment period and the Client notifies Dolmen in writing within seven days of termination.
The guarantee does not apply where the role is made redundant, the Client materially changes the role or employment terms, or termination results from the Client’s breach of its obligations. The replacement search is subject to an unchanged role specification and remuneration package. A replacement appointment is subject to suitable candidate availability; a successful replacement cannot be guaranteed.
No cash refunds are provided. The guarantee is a replacement search, not a refund or credit. Any separately agreed retained-search guarantee takes precedence.
7. Confidentiality
Candidate information is confidential and is supplied solely for assessing suitability for employment with the Client. The Client must not disclose it to another organisation or use it for unrelated purposes without appropriate authorisation. Confidentiality obligations continue after an assignment ends.
8. Client checks and responsibilities
Dolmen takes reasonable care in assessing Candidates. The Client remains responsible for the final hiring decision and for verifying qualifications, references, professional or regulatory approvals, eligibility to work and any other checks relevant to the appointment. Employment terms are agreed directly between the Client and Candidate.
9. Data protection
Dolmen and the Client each act as independent data controllers for personal data they process. Each must comply with the GDPR and applicable Irish data protection law, use Candidate data only for lawful recruitment purposes, keep it secure and retain it only for as long as necessary. Candidate details must not be forwarded without an appropriate lawful basis. The parties will cooperate on data-subject requests and promptly inform each other of relevant data breaches.
Further information about Dolmen’s processing of personal data is available in our Privacy Policy.
10. Liability
To the extent permitted by law, Dolmen’s aggregate liability arising from its services is limited to the fees paid by the Client to Dolmen in the 12 months preceding the event giving rise to the claim. Neither party is liable to the other for indirect or consequential loss, including loss of profits. Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Ending an assignment
Ending an assignment does not affect fees already earned, outstanding payment obligations, confidentiality, data protection obligations or fees arising from subsequent Engagements covered by these terms. Any cancellation arrangements for retained assignments will be set out in the written assignment agreement.
12. Governing law and enquiries
These terms are governed by Irish law and disputes are subject to the jurisdiction of the Irish courts. Please raise any questions before an assignment begins by contacting info@dolmenrecruitment.ie or calling + 353 01 9081860.
